Mr. Sameer Shah is associated with one of the renowned Solicitor’s Firm of Gujarat and gained expertise in the work of legal due diligence, drafting diverse legal documents. He also conducts litigation before the Trial Courts at Ahmedabad, District Courts in the State of Gujarat, the Gujarat High Court, Debt Recovery Tribunal and various quasi-Judicial Authorities. He has personally attended and gave advised to all the major clients of the firm, whether from government sector, corporate sector or individuals. During the said tenure he also completed the Articles for Solicitor.
In 2003 Mr. Shah established his own proprietary law firm at Ahmedabad, State of Gujarat, under the name and style of S. U. SHAH & ASSOCIATES. With years of practise and experience and with capable legal and administrative staff/associates, he was able to diversify the scope of work of the firm to include the services of Arbitration & Conciliation, Consumer disputes, matrimonial issues and counselling, commercial disputes and diverse Civil Litigations, throughout the State of Gujarat.
Mr. Shah has regularly been invited as one of the Panel Arbitrator Judge by the Willem C. Vis (East) International Commercial Arbitration Moot Competition held at Hong Kong and the International Moot Competition at Shanghai, China.
Mr. Shah has acted as Coach/Tutor for various teams participating in the Willem C. Vis (East) International Commercial Arbitration Moot Competition held at Hong Kong, including team from Fudan University, Shanghai, Kathmandu Law University, Nepal and various teams from National Law Universities in India.
Mr. Shah regularly conducts training courses as Tutor for CIArb-India at Mumbai, Delhi and Chennai for training professionals as Arbitrators. Also conducting awareness and training course specially modelled for Law Students of various Law Schools in India.
Mr. Shah has been invited to attend including as Speaker various National and International Conferences on Arbitration and Mediation.
He has been engaged as a Counsel for many the clients to represent them in Arbitration Proceedings, which includes both preparing the pleadings/case papers as also conducting arguments. Also appearing for clients in Challenge proceedings that may be filed by the aggrieved party against the Award that is passed in the Arbitration.
Mr. Shah has been retained as Counsel by one of my corporate clients to conduct the Arbitration Proceedings for recovery of loan/mortgage amount lend by the client to various customers for purchase of car/vehicle and/or as a personal loan. The scope of retainer includes Appearing and conducting proceedings under Section 9 of the Act for obtaining Receiver Orders, issuing notices for invocation of arbitration agreement, appointment of arbitrator, filing statement of claim with the arbitrator and as such conducting and representing the case for the client till the passage of award being passed and thereafter also to get the said Award executed/enforced by the appropriate Court.
He also practices in other forms of ADR mainly in family/matrimonial and also in commercial disputes.
Mr. Shah has been appointed as a co-arbitrator in the panel in a construction dispute arbitration seated at Mumbai.
He has been appointed as a Sole Arbitrator by a Petro-Chemical Trading Company in Mumbai for disputes relating to its customers for recovery of outstanding amounts. One of the Award passed by me has been confirmed by The Hon’ble Mumbai High Court.
Mr. Shah is regularly retained by clients to appear before the Arbitral Tribunal of the Stock Exchanges.
He was recently retained by an Indian Investor to represent the case before the Arbitral Tribunal at Dubai in an Arbitration Case being conducted under the Rules of Dubai International Arbitration Centre (DIAC).
He has been retained by a technology innovation company based out of Pune to represent it as a Counsel in an technology related Arbitration against a Government entity.
Mr. Shah has also been retained by an Australian company to represent it in an International Arbitration against a company from Taiwan.
He was also retained by the Indian subsidiary of an English Project Management Company to represent it in Arbitration disputes with a State of Gujarat Government entity in a Maritime construction dispute.
Mr. Shah made a presentation on behalf of CIArb India branch on training of Arbitrators before the Commission formed by the Government of India under the Chairmanship of Mr. Justice B.N.Srikrishna (Retd.) to suggest reforms in the Arbitration practice and law in India.
He has been invited and Empanelled by Mainland – Hong Kong Joint Mediation Center at Hong Kong as International Accredited Professional Mediator and with Hong Kong Mediation Services Ltd., Hong Kong as a Mediator.
Mr. Shah is actively promoting Mediation in India. He is regularly conducting trainings and workshops for Mediation development and also giving coaching to students and other professional on Mediation and Advocacy skills for it. He is currently promoting Online Mediation training and proceedings and developing an online Mediation Training Module for persons interested to gain knowledge about Mediation and its proceedings.
Mr. Shah has been retained by Sichuan Jian’an Industry Co., Ltd. China as Counsel for its India Investment.
He has also been retained by WECAN M&E (SHANGHAI) CO., LTD., Shanghai, China for giving legal advice and opinion on India Law and joint venture.
He was also retained by China Lihansu Investment Ltd. China as its India Counsel for its investments in India and giving all legal advice and opinions.
He was retained by Continental Carbon India ltd. a subsidiary of a Taiwan based company to conduct due diligence for its industrial land requirement in Gujarat.
Mr. Shah has been retained by Kotak Mahindra Bank and Group Companies since 2004 for legal Due Diligence, mortgage/loan/security document drafting and vetting, and litigation work in the State of Gujarat.
He was also retained by IDFC Bank, RBL Bank and HSBC Bank Ltd., for legal due diligence, mortgage/loan/security document registration work in Ahmedabad District.
He was retained by TATA Capital Financial Services Ltd. for legal due diligence, mortgage/loan/security document registration work in Gujarat.
He is empanelled with Bank of Baroda for Legal Due Diligence assignment.
Mr. Shah was also retained by Moser Baer Co. for its land acquisition matter in Dist. Banaskantha in Gujarat for its Solar Power Plant.
He was retained by majority of the Private Insurance Companies for Due Diligence work for premises in the State of Gujarat and also for consumer litigation and other legal disputes in the State of Gujarat.
Also retained by all the major Mobile/Cellular Service Providers Such as Vodafone, Idea Cellular Ltd., Mr. Shah did Due Diligence work in the State of Gujarat, for drafting and vetting of lease deeds, license agreements and its registration work and also for litigation and legal advice.
He was also retained by Indus Towers Ltd. for conducting the legal due diligence of agreements, contracts and all documents at the time of incorporation of the company by its promoter companies being Airtel, Idea and Vodafone.
He was retained by BNP Paribas, Mumbai for the legal due diligence, vetting and legal advise for its contracts and agreements related to IT infrastructure and related activities with various domestic and international Vendors.
With a vision of further growth and expansion, particularly in the Corporate and Financial-Legal Sector, he has been enrolled as an active member of INDO-CHINA CULTURAL AND ECONOMIC COUNCIL (ICEC) and also INDO-CANADIAN BUSINESS CENTER (ICBC). Through the said Organizations, the service of the firm are being sought for providing legal advise and guidance including Corporate Structure, Joint Venture Advise, Company Incorporation in India, Legal and financial Due Diligence etc. to the companies based in China and Canada. The firm is currently retained by companies from China and Canada for company incorporation, Legal and Financial Due Diligence, JV and other related work in India.
